This Privacy Policy describes how we handle your PII:

That you share with us to avail our services;

That we gather when you engage with us in other related ways – including any sale, marketing or events; and
That we collect from government records (“Public Records Data”) for use in the provision of background check information to our clients. Most privacy legislation excludes Public Records data from the definition of “personal information” that is governed by such legislation; however, for transparency, we explain how we collect, use and disclose Public Records Data in this Policy.

In this Policy, if we refer to:

“Website”, we are referring to any website of ours that references or links to this policy.
“Services”, we are referring to the services that we offer to our clients.

WHO ARE WE?

Company is a public records wholesaler operating on behalf of consumer reporting agencies (CRAs) or other public records wholesalers. The Public Records Data that we collect includes, but is not limited to, civil lawsuit records, criminal records, and/or history of arrests and/or convictions. We obtain our Public Records Data directly from the courts and do not purchase or resell any third-party database. We then provide such Public Records Data to our clients for the purpose of making decisions regarding employment, verification of credentials, and tenancy. We only sell Public Records Data to consumer reporting agencies and reputable wholesalers, not to individual consumers.

Our clients certify to us that they have obtained necessary consent from the data subject and have notified them regarding background screening requirements in accordance with all applicable laws and regulations. Our clients certify that the data subjects are fully informed about the purposes for which their Public Records Data is collected and used, the types of third parties their information is shared with, and how to exercise their privacy rights, where applicable. Our clients provide this notice to the data subjects and only share the personal details with 1800Support that the data subjects have agreed to.

Company is distinct from any third parties. As used in this Policy, the term “third parties” means any person or entity other than you and Company and our employees. Third parties include, but are not limited to, government agencies (such as the courts where we obtain our Public Records Data), CRAs, and our service providers that help us provide our Services. This Policy may not apply to certain third-party practices, websites, mobile apps, or services. Third parties may have their own privacy practices and policies, over which we have no input or control.

WHAT INFORMATION DO WE COLLECT?

Information you provide to us. We collect personally identifiable information (“PII”) and other data directly from you through the Website or Services, such as:

when you browse or complete a form on the Website;
when you inquire about the Services;
when you make payments to us; and
when you communicate with us, such as by sending us an email or speaking to one of our customer service agents.

Information from third parties. We also collect PII and Public Records Data from third parties, such as:

when we receive an inquiry from a client;
when we collect Public Records Data from government sources; and
when we receive an inquiry for specific Public Records Data or PII from a client.

Information from automated technologies. Like most websites and mobile apps, we collect data through automated technologies on our Website, such as through the use of cookies, web beacons, and pixels. These practices are discussed more fully in the section below entitled Cookies and Other Data Technologies.

HOW DO WE USE YOUR COLLECTED INFORMATION ?

The information collected through our Website is used for a variety of purposes described below. We use it for our legitimate business purposes, in order to provide the Services to our clients, enter into or perform a contract with you, to personalise your experience, to improve our Services and to communicate with you regarding our Services and marketing or promotions.

HOW DO WE PROCESS AND PROTECT SENSITIVE PII?

Certain categories of PII and Public Records Data collected, such as Government-issued identification and protected classification characteristics, may qualify as “Sensitive PII” under applicable law.

We only collect and use Sensitive PII when reasonably necessary for and proportionate to one of the following business purposes: (a) to perform certain Services, such as verifying information or for analytics; (b) to verify or maintain the quality or safety of our Services; (c) to perform Services reasonably expected by you; (d) for short-term use where there is no disclosure or profiling; and/or (e) to resist malicious, fraudulent, or illegal actions or to ensure physical safety.

We employ industry-standard security measures to protect the Sensitive PII we collect, including encryption, access controls, and regular security assessments to prevent unauthorized access, disclosure, or alteration of the data.

Sensitive PII will be retained in compliance with any legislation governing the retention and deletion of such data.

HOW DO WE SHARE INFORMATION WITH THIRD PARTIES?

As part of our business purposes, we disclose certain PII and Public Records Data to third parties as follows:

To Our Clients – We disclose Public Records Data to our clients upon request in provision of our Services as a wholesaler of court records.
To Our Service Providers – We disclose PII and Public Records Data to our third-party service providers and other vendors who assist us in performing the Services. For example, we may disclose payment information to our third-party payment processor. Our service providers are contractually obligated to: (i) to use, handle, and maintain same levels of confidentiality and protection of PII and Public Records Data consistent with this Policy, and (ii) notify Company immediately if they determine that they no longer meet the standards of this Policy.
To Comply With Our Legal Obligations – We may disclose information as necessary to comply with our legal obligations, such as to respond to government requests, law enforcement inquiries, legal process, subpoenas, and court orders. We may disclose information when we believe it is necessary to investigate, prevent, or respond to illegal, fraudulent, or injurious actions or security incidents that may cause harm to us, our property, or others. We may also disclose information in good faith where necessary to investigate or enforce a violation of this Policy, our terms, or any legal rights.
To Complete a Merger or Sale – We may share information with a buyer and/or its representatives for business purposes as part of a sale, merger, acquisition, or other change in control or entity status for our Company. We reserve the right to transfer or assign PII and Public Records Data as part of any such transaction or investigation, so long as the surviving entity agrees to comply with this Policy.
To Comply With Your Request – We may disclose PII or Public Records Data to third parties as requested or consented to by you. Such disclosure may be for any business or commercial purposes as described by you in your request.

WHAT COOKIES AND OTHER DATA TECHNOLOGIES DO WE USE?M

As with many companies, we may use cookies, pixels, gifs, web beacons, log files, and/or similar technologies to automatically collect certain information, including device, internet, and network data, general geolocation data, inferences, and aggregate information or de-identified data, when you use the Website or Services or interact with our digital advertising content, such as when you click on an advertisement or a link to the Website within an email. This allows us to track individual users, determine when content is accessed, and customize user experiences.

Unless you have opted out of cookies or changed your cookie settings in your internet browser, your browser automatically sends us certain device, browser, internet connection, and general geolocation information and certain internet activity information. For instance, we may collect your mobile device identifier or MAC address, ISP carrier information, date and time you access the Website, the pages you visit, and whether you click on ads.

“Profiling cookies” are supplied and managed by Third Parties to generate specific advertising messages based on browsing habits and the interests of individual users. WHAT ARE OUR MARKETING PRACTICES?

Marketing Communications

When you provide us your email address via the Website, you may receive emails about your account, our Services and related services that may include marketing messages. You can opt-out of receiving marketing communications by email by clicking the unsubscribe link and following any subsequent instructions.

Please note that we may still contact you regarding your Services, account, and transactions with us, even after you have opted out of marketing communications.

DO WE SELL PERSONAL DATA?

As a wholesaler of Public Records Data, we are engaged in the business of selling Public Records Data to our clients. In most instances, Public Records Data about a specific individual is only provided when such individual has expressly consented to the same. Except as described above, we never sell your PII or Public Records Data. We only process such information as outlined in the Policy and for the intended business purposes.

HOW DO WE KEEP YOUR INFORMATION SAFE?

Although no electronic transmission on computer network is impervious to cyber-attacks, 1800Support Inc has implemented State-of-the art physical, technical and operational security measures to protect the data you have shared with us from unauthorised access.

Some of these measures including carrying out background checks on employees handling the data, technological measures and operational measures (for example: need to know basis selective access of data for employees).

We commit to accurately provide information in our services to our clients and we take reasonable steps to ensure that information we provide to our clients is accurate, current and reliable for its intended use. We, however, cannot be responsible for errors or omissions within public court records.

We collect information for the purpose of background screening for employment and for other purposes permissible under the FCRA. We only retain any information on the consumers for as long as it serves the purpose that the data was collected for, following which all data is deleted.

DO WE COLLECT INFORMATION FROM MINORS?

We do not intentionally collect any information from children under the age of 13. If we learn that personal information from users less than 13 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. WHAT ARE YOUR PRIVACY RIGHTS?

We value your privacy rights. If you want to make a privacy request or have any questions, please contact us through our Contact Form or email [email protected] with your name and email address or other identifier used in connection with our Service so that we can verify your request.

If an authorized agent is making a request on your behalf, the agent should provide its name and contact information, such as an email address, in addition to your information. There may be situations where we cannot grant your request; for example, if you make a request and we cannot verify your identity, or if you request deletion of data that we have a legal obligation to keep. Where we deny your request in whole or in part, we will take steps to inform you of the denial and provide an explanation of our actions and the reasons for the denial.

Applicable privacy laws have different requirements and depend on various factors, such as where you live and how much revenue or data is at issue. Generally, we adhere to the following set of privacy rights to the extent applicable and subject to any limitations authorized by law.

Amend. You can amend, correct, or rectify your data if it is inaccurate. Note, however, that Company is not a consumer reporting agency and has no ability to amend or correct your Public Records Data or update your credit report.
Delete. You can have your data deleted subject to certain legal limitations.
Limit. You can limit the processing of your data, in particular any sensitive data, and limit use of automated decision making, such as profiling.
Opt-Out. You have the right to opt-out of certain data practices. For example, you can unsubscribe from marketing communications by following the opt-out instructions in each message or by contacting us as outlined in this Privacy Policy (please note that we may still send non-marketing messages, and that consent to receiving marketing communications is not mandatory to use the Service). You may opt out of the use of automated decision-making technology if applicable. We will also respond to recognized global opt-out preference signals where we can verify the request. Complaints. You have the right to make certain complaints, including for privacy concerns. We value your feedback and seek the opportunity to work with you on any issues. You have the right to no discrimination for asserting your privacy rights.

For example, the California Consumer Privacy Act (“CCPA”), updated by the California Privacy Rights Act (“CPRA”), governs certain California-related conduct. Under California’s “Shine the Light” law, California residents may also request certain information regarding Company sharing personal information with third parties for their direct marketing purposes. Further, if you are a California resident under the age of 18, California Business & Professions Code Section 22581 permits you to request and obtain removal of content you have publicly posted. DO WE RESOPND TO DNT SIGNALS OR GPC?

Our Website does not currently respond to DNT, short for Do Not Track, requests. DNT is a feature that, when enabled, sends a signal to websites to request that your browsing not be tracked.

“GPC” is short for short for Global Privacy Control settings in your browser or extension. We recognize GPC signals. This means that if your browser has GPC enabled, our website will automatically recognize your GPC signal and opt you out of the sale of your personal information, if any. DO WE MAKE UPDATES TO THIS POLICY ?
